Welcome to Beth & Birdie Jewels. These General Terms and Conditions apply to all contracts with Beth & Birdie Jewels. Article 1 - Definitions

The following definitions apply in these terms and conditions:

  • Cancellation period: The period during which the consumer can exercise their right of cancellation.
  • Consumer: A natural person who is not acting in a commercial capacity and concludes a distance selling contract.
  • Day: Calendar day.
  • Fixed-term contract: A contract that runs for a specific period of time and relates to several products or services.
  • Durable medium: A medium that allows consumers or businesses to store information and retrieve it later without alteration.
  • Right of withdrawal: The consumer's right to cancel a distance selling contract within the withdrawal period.
  • Business: The natural or legal person who offers products or services via distance selling.
  • Distance selling contract: A contract that is concluded exclusively via means of distance communication.
  • Remote communication means: A means by which a contract is concluded without simultaneous physical presence.
  • General Terms and Conditions: The company's terms and conditions.

Article 2 - Identity of the company

Article 3 - Scope

These terms and conditions apply to all offers from the company as well as to all distance selling contracts and orders between companies and consumers.

Before concluding a distance selling contract, the text of these terms and conditions will be made available to the consumer. If this is not possible, the consumer will be informed where the terms and conditions can be viewed and that they will be sent free of charge.

If specific product or service terms and conditions apply in addition to these terms and conditions, they shall apply supplementarily. In case of discrepancies, the consumer may invoke the more favorable provision.

Should any provision of these terms and conditions be invalid or unenforceable, the remainder of the contract shall remain in full force and effect. The invalid provision shall be replaced by a valid provision that comes as close as possible to achieving the intended purpose of the invalid provision.

Unclear or unregulated cases will be assessed in accordance with these terms and conditions.

Article 4 - Offer

  • If an offer is limited in time or subject to conditions, this will be explicitly stated.
  • This offer is non-binding. The company can change it at any time.
  • The product or service descriptions are accurate and complete. If images are used, they depict the products as realistically as possible. Obvious errors in the offer are not binding.
  • All images and information are approximate. Deviations do not entitle the customer to terminate the contract.
  • Color variations between images and the actual products are possible.

Each offer contains clear information about:

  • the price (excluding import duties and import sales tax, which are borne by the customer).
  • Shipping costs.
  • the conclusion of the contract and the necessary steps.
  • the possibility of cancellation
  • Terms of payment, delivery and contract.
  • the duration of the offer or the price guarantee.
  • additional costs for remote communication devices.
  • the storage of the contract and the method of access for the consumer.
  • Correction options for the consumer before concluding the contract.
  • Other available contract languages.
  • Applicable codes of conduct and how to access them
  • the minimum contract duration for long-term contracts.
  • Available sizes, colors and materials (if relevant).

All orders are shipped from a non-EU country (e.g., China) by default. Delivery is made according to the standard postal/courier service.

Import VAT and any applicable customs duties are paid by the consumer directly to the respective delivery service (e.g., DHL, Deutsche Post, or Hermes) upon delivery.

The company expressly points out that these costs are not included in the purchase price and are subject to the applicable import regulations of the recipient country.

Article 5 - Conclusion of the contract

  • The contract is concluded when the consumer accepts the offer and fulfills the conditions.
  • For electronic orders, the company confirms receipt immediately. Without confirmation, the consumer can withdraw from the contract.
  • The company takes appropriate security precautions to protect electronic data.
  • The company is permitted to conduct credit checks. If there are legitimate doubts, the order may be rejected or made subject to special conditions.
  • After the conclusion of the contract, the consumer receives a written or electronic confirmation with important contract information.

If a product is unavailable, the contract will be concluded subject to availability.

Article 6 - Right of withdrawal

  • The consumer can withdraw from the contract within 14 days of receiving the goods without giving any reason.
  • During the cancellation period, the product must be handled with care. It may only be unpacked or used to the extent necessary for inspection.
  • To exercise the right of withdrawal, the consumer must notify the seller in writing or by email and return the product within 14 days.
  • If the product is not returned on time, the purchase contract remains valid.

Article 7 - Costs in case of cancellation

  • The consumer bears the return shipping costs.
  • Payments already made will be refunded within 14 days of receiving the returned goods.

Article 8 - Exclusion of the right of withdrawal

The right of withdrawal is excluded in the following cases:

  • Products manufactured according to customer specifications.
  • Personal or perishable products.
  • Sealed hygiene products, if the seal has been removed.
  • Audio and video recordings or software with a broken seal.

The right of withdrawal is also excluded for certain services, e.g.:

  • Travel, transport or leisure activities with a fixed date.
  • Services that were started with the consumer's consent before the end of the withdrawal period.

Article 9 - Prices

  • Prices will remain stable during the offer period, except in the event of changes in VAT.
  • If prices depend on market fluctuations, this will be stated in the offer.
  • Price increases within 3 months of the conclusion of the contract are only permitted if required by law.
  • After 3 months, price increases are only permitted with the consumer's consent.
  • All prices are subject to change without notice. Printing errors or mistakes do not constitute grounds for a claim.

Article 10 - Warranty

  • The company guarantees that its products and services comply with the contract and legal regulations.
  • The statutory warranty remains unaffected.
  • Defects must be reported within 14 days of receipt.
  • The warranty does not apply in cases of improper use or self-repair attempts.

Article 11 - Delivery

  • Delivery will be made to the address provided by the consumer.
  • If delays occur or a product is unavailable, the consumer will be informed within 30 days and can withdraw from the purchase.
  • In case of cancellation, the purchase price will be refunded within 14 days .
  • If a product is unavailable, a replacement product can be supplied.

Article 12 - Term and termination of contracts

  • Consumer contracts with an indefinite term can be terminated with one month 's notice.
  • Fixed-term contracts end automatically unless an extension has been agreed upon.
  • Contracts must not be tacitly extended for a long period of time.

Article 13 - Payment

  • Payments are due within 7 working days .
  • Incorrect payment information must be reported immediately.
  • Late payment fees may be charged for non-payment.

Article 14 - Complaints

  • Complaints must be submitted within 7 days of discovering the defect.
  • The company responds to complaints within 14 days .

Article 15 - Disputes

  • German law applies exclusively.

Article 16 - CESOP

Payment service providers can report transactions to the central European Payment System (CESOP) due to new legal regulations.
